Weld County commissioners voted 5 to 0 on September 9, 2026 to approve a use by special review permit for an initial 41 acre, 27.5 megawatt phase, adding conditions requiring closed loop cooling, noise monitoring, and a decommissioning bond. The county had earlier issued three stop work orders in 2026 after finding construction underway without required permits, and water supply for the site remains unresolved.
